Conflict Mediation

Mediation is one, being especially suited to all cases in which there is interest on the part of its stakeholders, to meet not only the present but also the future consequences of the extrajudicial solution, private and voluntary action for conflict resolution find, allowing, in addition, maintaining their relationships (commercial, neighborhood, friendship, family, good name, etc...) or their improvement through an attitude of accountability and civic cooperation, respectful and confidential, in resolution of the problem and its future compliance.
How long has mediation in Portugal?
Mediation is a recent feature in Portugal, however, has been used successfully, for some thirty years in the United States, as well as more recently in Canada, Japan, China, and countries in Europe, Africa and Latin America such as Argentina and Brazil.
Who can use mediation as a way to solve their problem?
Any persons, physical or legal, involved in conflicts or disputes, who need or desire to manage either a preventive purpose, either with a view to resolution.
If the prosecution has begun, you can still use mediation?
Can. Mediation may be present before, during or after the court ruling. Extrajudicial dispute resolution tools emerge to wreak judicial task in what it can give up.
Who participates in mediation?
Those who have power to decide the issues at hand. In the case of mediation within the competence of the Peace Courts, the parties will always have to appear in person, a legal person shall be represented by attorneys with special powers to give up, confess or settle. In the case of other mediations, legal representatives may take part if proven participation of those directly involved in the situation impossible. In this case such action shall be negotiated and accepted by the other participants in the process.
